Information regarding garages and parking spaces
If you want to rent out a space in a garage or a parking space (hereinafter referred to collectively as parking space), you need to clarify the following: Will the parking space be rented together with an apartment or commercial space, or will a separate rental agreement be concluded for the parking space?
If you rent out the parking space together with an apartment or commercial space, rental provisions will apply (e.g. in the event of a termination or increase in rent). In addition, the same notice periods and dates apply to the parking space as those that apply to the apartment or commercial space.
By contrast, if you rent out the parking space separately – without an apartment or commercial space – the abovementioned protection provisions do not apply. This means that you can agree on a shorter notice period in the contract, and that a termination or increase in rent cannot be appealed with the rent mediation office.
Rental agreements for parking spaces can be concluded orally or in writing. However, it is recommended to do so in writing.
